Description of Mark | The mark consists of a three-dimensional configuration of a white, rectangular box with a toile style design appearing in red on the top and the sides of the box consisting of trees and branches with leaves and flowers, with the drawings of small children throughout playing in different positions. A decorative red border encircles the top of the sides of the box. The lengthwise side of the box features a red drawing of three small children at play surrounding a tree, with one child on a branch dropping two stones, another child beneath the branch, and a third child to the left of the other two next to a water pipe. A similar design appears on the widthwise side of the box. The top of the box features a stylized red oval outlined with an ornamental border comprised of half-ovals, lines and dotted-lines, inside of which appears the red wording "VANALISSA CHOCOLATIER" in stylized red letters. Surrounding the oval is a stylized red design of trees, branches, leaves and flowers. To the bottom right of the oval is a stylized red design of a child next to a water pipe surrounded by branches, flowers and leaves. A similar red design appears to the bottom left of the stylized oval design. The entirety of the box is wrapped with a red bow the runs lengthwise along the top of the box and wraps around the widthwise portion of the box and also wraps around the left-hand portion of the box where the bow is tied in the upper left-hand corner of the top of the box. The broken lines depicting the box and bow indicate placement of the mark on the goods and are not part of the mark. |
