Description of MarkThe mark consists of the words "THE MILKSHAKE SPOT" stacked on one another with the word "THE" on top, the word "MILKSHAKE" in the middle, and the word "SPOT" on the bottom. These three words are center aligned. The three words are consistently formed by medium thickness lines and/or curves that present a fluid appearance. The font is unique. The stokes of the letters in these three words are varied, the shape and sizes of the letters are also slightly varied. There are no sharp corners on any of the letters, and there are two sharp corners or points on letter extensions as noted below. The first letter of each word is capitalized and is larger than the letters that follow it. The three words are bordered on all sides by curved strokes that are virtually identical in thickness to the strokes of the letters. The border strokes are meant to have the appearance of a soft-serve ice cream cone containing roughly three layers of ice cream where the layers increase in width in descending order from top to bottom. The crest of the ice cream cone comes to a sharp point and does not contain any words or letters. The top stroke of the letter "T" in the word "THE" roughly forms the bottom of the top layer of ice cream, it forms the top of the middle layer, and it curves downward on the left side of the mark to roughly form the left side of the middle layer. The far left vertical stroke of the letter "K" in the word "MILKSHAKE" extends upward and then curves to the left and wraps closely around the letters "MIL" in the word "MILKSHAKE" thereby forming approximately 75 percent of a complete circle (approximately 270 degrees), and it terminates under the letter "M" of the word "MILKSHAKE" just to the left of the far right stroke of that letter "M"; the far right stroke of that letter "M" extends downward approximately twice as far as the far left stroke on that letter "M". The far right downward stroke on the letter "A" within the word "MILKSHAKE" extends downward and then curves to the right and then upward wrapping around the letters "KE" in the work "MILKSHAKE" thereby almost forming a complete circle (approximately 350 degrees); but instead of terminating, the line which forms the curve narrows to a sharp point near the bottom right side of the letter "E" in the word "THE"; and then that curve forms another curved line that extends out to right and upward to form right side of the middle layer of ice cream; and then that curve forms the pointed crest of the ice cream cone. Thus, altogether, the curved line that initially extends downward from the letter "A" in the word "MILKSHAKE" forms the entire right side of the ice cream cone and the top crest of the ice cream cone. The bottom stroke of the letter "S" in the word "SPOT" extends to the left in an upward loop that circles back on itself and then continues in a line to the right that forms a curve under the word "SPOT" which also forms the top of the cone. That curve which forms the top of the cone is concave when viewed as part of the cone. That curve which forms the top of the cone is distorted under the letter "O" in the word "SPOT" to give the appearance of melting ice cream beginning to drip onto the cone. That curve which forms the top of the cone comes to a rounded point on the right side as it approaches the curve that extended downward from the letter "A" in the word "MILKSHAKE" and then it inverts downward to the left at an approximate 60-degree angled line which forms the right side of the cone. That angled line which forms the right side of the cone comes to a rounded point at the bottom which forms the bottom of the cone, and that line extends upward to the left at an approximate 60-degree angle to form the left side of the cone. There is a crisscross pattern on the interior of the cone that gives the appearance of a waffle cone. The height of the mark is almost the same as the width, but the height is slightly longer.
