Distinct Commercial Impression and Differences in Mark The applied-for mark PULSE ELITE TRAINING and the cited registered mark PULSE differ in overall commercial impression: PULSE ELITE TRAINING conveys a premium, structured fitness program, emphasizing both excellence ("ELITE") and instruction ("TRAINING"). PULSE, as registered, is a single word with a broad connotation that does not inherently imply an elite training system. The addition of "ELITE TRAINING" significantly alters the meaning and perception of the mark. 2. Differences in Design and Appearance The cited registration (Reg. No. 7096006) includes a design element, while the applied-for mark is in standard characters. The wording "ELITE TRAINING" differentiates the marks and reduces the likelihood of confusion. 3. Differences in Goods/Services and Target Audience While both marks operate in the fitness industry, there are notable distinctions: Registrant's mark covers "Infrared yoga and fitness classes", which is a specific type of yoga practice using infrared heat. Applicant's mark covers "Indoor cycling instruction and fitness services", with an emphasis on cycling and elite training programs.
