Description of MarkThe mark consists of The mark is intended to be a whimsical badge to be displayed on wearing apparel with a double meaning. In the first instance, the mark presents in printed-font the words "made from Marriage Material" (as if it was a clothing label identifying a type of fabric), but then an aggressive "X" in handwritten-font crosses out the words "Marriage Material" as if it was a discount store clerk striking out a regular price and reducing it to a sale price). Just underneath, in casual handwritten font the words "Damaged Goods!" appears on a tilt (as if the sales clerk quickly wanted to make clear to its customers that the product was damaged). The play on words is whimsical. It implies that it is not merely the wearing apparel that is damaged goods but the person wearing them as well! This person, who was once "marriage material" having come out of a failed relationship or divorce, has now become "damaged goods." It is the CONTRAST between the colors of the mark (not necessarily the colors themselves) as they appear against the backdrop of the color of the wearing apparel and the CONTRAST between the printed-font versus the handwritten-font, that are the most striking visual characteristics of the mark.
