After reviewing the refusal and the nature of Applicant's commercial use, Applicant acknowledges that the mark was misclassified in this application as Class 23 (yarns). The mark iDOKNiT functions primarily as a retail/online store brand for the sale of yarns and knitting supplies from multiple manufacturers and, separately, as the brand for Applicant's own handmade knitwear (garments). As such, the correct protection for Applicant's present commercial use lies in Class 35 (online retail store services) and Class 25 (knitwear/clothing goods), not Class 23. Accordingly, Applicant voluntarily withdraws the Class 23 identification in this application to avoid any implication that Applicant is the source/manufacturer of third-party yarns. In parallel, to preserve rights consistent with actual use, Applicant has filed a new multi-class application for Class 35 ("Online retail store services featuring yarns, knitting supplies, handmade knitwear, and related accessories") and Class 25 ("Knitwear, namely, handmade sweaters, cardigans, vests, scarves, and hats"). Applicant requests that this clarification be entered into the record to reflect accurate scope of use and ownership continuity (owner: Tatyana Zabegalin, U.S. citizen). In view of the foregoing voluntary narrowing amendment (deletion of Class 23) and concurrent re-filing in the proper classes, Applicant respectfully requests that the examining attorney enter the amendment and reconsider the Final Action to the extent necessary to close this application record appropriately. |
