| Concurrent Use Statement | Concurrent use information: Applicant currently uses the subject mark EZ MORTGAGES (and EZ MORTGAGES & Design) in U.S. commerce in connection with the offering and rendering of, and is licensed to provide, mortgage services, namely, brokerage, refinancing, and procurement for others, in the states of California, Colorado, Idaho, Minnesota, Tennessee, Utah, and Washington. Applicant has used the subject mark since 2014. Applicant seeks a concurrent use registration with prior registrant, EZ Mortgage LLC, 100 N. Main Street, Suite L102, East Peoria, Illinois, 61611, which is owner of Registration No. 6,892,473 for the mark EZ MORTGAGE & Design for "mortgage lending" in Class 36, which states a first use date of June 29, 2021. Registrant EZ Mortgage LLC uses the mark EZ MORTGAGE and EZ MORTGAGE & Design for mortgage lending services, and is licensed, in the states of Illinois, Florida, Georgia, Iowa, North Carolina, South Carolina, and Virginia. Registrant EZ Mortgage LLC has used the subject marks since 2021. Both concurrent users market their respective services through the internet. Both concurrent users render their services to prospective and actual mortgage borrowers with respect to properties within the concurrent users respective licensed states. Applicant's and Registrant EZ Mortgage LLC's respective design marks are visually different, and their respective word marks differ visually and aurally (i.e., singular versus plural). Pursuant to the attached Trademark Coexistence and Concurrent Use Agreement between Applicant and Registrant EZ Mortgage LLC and with Registrant's consent to concurrent use registration to Applicant, Applicant seeks concurrent registration for the following geographic region: the states of Alaska, Arizona, California, Colorado, Hawaii, Idaho, Kansas, Minnesota, Montana, Nebraska, Nevada, New Mexico, North Dakota, Oklahoma, Oregon, South Dakota, Tennessee, Utah, Washington, Wyoming, and U.S. Territories in the Pacific (the "Applicant's Geographic Scope"). Registrant EZ Mortgage LLC consents to the geographic limitation of its registration to the remainder of the United States and its territories, excluding Applicant's Geographic Scope. |
