| Concurrent Use Statement | Applicant began using the "ENFERNO" mark in commerce in April 1994 and has continued using it since then. Applicant does not know the exact date when Dante Coleman began using "ENFERNO" or "DJ ENFERNO," but Applicant notes that Mr. Coleman was deemed the junior user under the coexistence agreement between Applicant and Mr. Coleman. Further, Applicant notes that Mr. Coleman has cited September 7, 2022, as the date of first use in commerce of the mark "DANTE'S ENFERNO" (see Registration No. 7139601). In addition, as evidenced in the appended coexistence agreement, Mr. Coleman has agreed "not to object to, or contest, or assist or encourage any other person or entity to interfere with, object to, or contest, [Applicant's] use of the Mark in all states within the United States including but not limited to [Minnesota, Wisconsin, Iowa, North Dakota, and South Dakota]." |
